01Acceptance of Terms
By requesting a quote, scheduling a pickup, or tendering a shipment to Neverstill Transport, LLC, you agree to these Terms & Conditions on behalf of yourself and any company you represent.
If you do not agree with any part of these terms, do not tender shipments to us. Continued use of our services after an update to these terms constitutes acceptance of the revised terms.
02Services Provided
Neverstill Transport provides expedited courier, same-day delivery, emergency courier response, scheduled recurring routes, and regional delivery throughout Florida using cargo vans and light commercial vehicles.
We are not a freight broker, a warehouse operator, or a common carrier of household goods. Service acceptance is always subject to vehicle capacity, driver availability, and shipment eligibility.
03Quote Disclaimer
Quotes are estimates based on the pickup and delivery details supplied by the customer at the time of the request, including distance, weight, dimensions, handling requirements, and time window.
If actual conditions differ from what was quoted — additional stops, larger or heavier freight, extended wait time, after-hours timing, tolls, or access restrictions — the final invoice may be adjusted accordingly. Dispatch will communicate material changes before proceeding whenever practical.
04Customer Responsibilities
- Provide accurate pickup and delivery addresses, contact names, and phone numbers.
- Accurately describe the contents, weight, dimensions, and any special handling needs of each shipment.
- Ensure freight is properly packaged and secured for transport before the driver arrives.
- Provide any required paperwork, labels, seals, or chain-of-custody documentation.
- Ensure an authorized person is available at both ends of the run within the agreed window.
- Disclose any regulatory, licensing, or temperature requirements that apply to the shipment.
05Pickup & Delivery Requirements
Drivers must have safe, legal access to the pickup and delivery locations, including gate codes, dock access, suite numbers, and parking where applicable.
Loading and unloading assistance is provided at the driver's discretion and within safe lifting limits. Freight requiring a forklift, liftgate, or multi-person handling must be identified in advance.
06Delivery Windows
Delivery windows are commitments we plan and dispatch against, not guarantees against conditions outside our control such as traffic, weather, road closures, or delays at the pickup site.
When a window is at risk, dispatch will notify the customer as early as possible with a revised estimate.
07Payment Terms
Non-account customers pay at the time of booking or upon completion of the run unless other arrangements are made in writing.
Approved business accounts are invoiced on agreed terms, typically net monthly billing. Past-due balances may result in suspension of service until the account is brought current.
Rates quoted exclude tolls, parking fees, and after-hours premiums unless specifically stated in the quote.
08Cancellation Policy
Cancellations made before a driver is dispatched are not charged. Once a driver has been dispatched and is en route to the pickup location, a cancellation fee reflecting the miles and time already committed may apply.
Recurring route cancellations or schedule changes should be provided with reasonable advance notice so drivers and capacity can be reassigned.
09Limitation of Liability
Neverstill Transport's liability for loss or damage to a shipment is limited to the documented repair or replacement value of the goods, up to the coverage limits carried for the vehicle and cargo in service at the time of transport.
We are not liable for indirect, incidental, consequential, or special damages, including lost profits, lost business opportunity, downtime, or contractual penalties resulting from a delayed or missed delivery.
Claims for higher declared value must be arranged and confirmed in writing before pickup.
10Force Majeure
Neverstill Transport is not responsible for delays or non-performance caused by events beyond our reasonable control, including hurricanes and severe weather, flooding, fire, accidents, road closures, civil unrest, labor actions, acts of government, or failures of public infrastructure.
11Governing Law
These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these terms or from services performed shall be brought in a court of competent jurisdiction located in Florida.
